Discrimination and harassment

At CA Technologies, we strive to make all of our employment related decisions based on merit. We don’t allow discriminatory attitudes about things like race, color, gender, religion, national origin, age, marital status, citizenship status, political belief, disability, pregnancy, military service, veteran status, sexual orientation, gender identity, genetic information, medical condition or any other category covered by law to influence employment-related decisions including decisions involving recruitment, hiring, promotion and employment termination. All other personnel actions—such as those concerning compensation, benefits, transfers, layoffs, returns from layoffs, Company-sponsored training, education, tuition assistance, and social and recreational programs—are also administered in a non-discriminatory manner in accordance with Company policy.

Managers are responsible for ensuring that all personnel actions are free from discrimination and that the principles of providing equal employment opportunity for all persons are observed every day. CA Technologies is proud of its professional and congenial work environment and is committed to ensuring that the work environment remains pleasant and free of harassment. We expect all CA Technologies employees to treat one another with courtesy, consideration and professionalism.

CA Technologies will not tolerate harassment in any form. The types of harassment covered by this policy include harassment directed at an employee because of the person’s race, color, gender, religion, national origin, age, marital status, citizenship status, political belief, disability, pregnancy, military service, veteran status, sexual orientation, gender identity, genetic information, medical condition or any other classification protected by applicable law. Those who engage in harassing behavior will be subject to discipline up to and including termination of employment.

So everyone is clear on what we are referring to, forms of prohibited conduct and harassment include, but are not limited to:

Verbal: Repeated unwanted requests for dates, sexual innuendos, racial or sexual epithets, derogatory slurs, foul or obscene language, off-color jokes, inappropriate propositions, questions about another's sexual experiences, threats, or suggestive or insulting remarks or sounds;

Visual/non-verbal: Inappropriate written materials (including email and online content), derogatory posters, cartoons or drawings, suggestive objects or pictures, leering, or obscene gestures;

Physical: Interference or assault ranging from intentionally impeding or blocking someone’s way to unwanted physical contact (for example, touching, rubbing or massaging someone's neck or shoulders or brushing against another's body);

Other: Making or threatening reprisals as a result of a negative response to harassment.

CA Technologies forbids retaliation of any kind against you for reporting or participating in a harassment or discrimination investigation.

It is our expectation that employees will speak up whenever they witness or suspect discrimination or inappropriate workplace conduct. To this end, CA Technologies strictly prohibits any form of retaliation against an employee or other person who, in good faith, reports actual or suspected wrongdoing. Any employee who retaliates against another for raising or escalating concerns with CA Technologies will be subject to disciplinary action, up to and including termination of employment.

What would you do?

I want to apply for a job in another part of CA Technologies, but was told that the supervisor of the position thinks the role should be filled by a young employee.

Isn't that against Company policy?

Yes.

CA Technologies does not allow discriminatory attitudes about age or any other category protected by law to influence hiring decisions. You should report this matter to your local Human Resources Business Partner or a member of the Business Practices and Compliance Team.

Disability accommodation

CA Technologies is committed to working with and providing reasonable accommodations for employees and applicants with physical or mental disabilities. We encourage all employees with disabilities who need some assistance from CA Technologies to simply speak up—contact your local Human Resources Business Partner and begin a dialogue. Here at CA Technologies, we want to help ensure the success of all our employees.

Health and safety

You should be familiar with and follow all safety guidelines and report any unsafe working conditions or workplace accidents. Any acts or threats of violence towards another person or abuse of Company property should be reported immediately to your local Human Resources Business Partner, any member of the Worldwide Law Department or any member of the Global Security Team.

You must not report to work or work under the influence of unauthorized or illegal drugs and/or alcoholic beverages. You also must not illegally manufacture, distribute, dispense, possess or use controlled substances in the workplace.

What would you do?

One of my co-workers frequently tells dirty jokes which make me feel uncomfortable, but I know he means no harm by them.

Is there anything I can do about this?   Yes.

This sort of humor has no place at CA Technologies, and could violate our policies and the law. You should let the co-worker know how you feel. If you prefer, you may instead speak with your Human Resources Business Partner or a member of the Business Practices and Compliance Team.
